Abstract

The article considers whether a landlord has a legal right to retain keys to its tenant's premises. In particular, it argues that retention of keys is not conclusive of the tenant's legal status and looks at express and implied terms allowing the retention of keys. It also asks whether the tenant's act of changing the lock constitutes an unauthorised alteration to the demised premises or an act of waste or breach of the implied term of tenant-like user.
