Abstract

Analyses the Chancery Division decision in Clarke v Meadus on whether the existence of an express declaration of trust concerning beneficial shares in the family home precluded the establishment of a constructive trust or proprietary estoppel, reflecting subsequent changes in circumstances, varying the terms of the express trust. Examines previous case law on the effect of a declaration of trust.
