Abstract

Reports the Court of Appeal decision in Patel v K&J Restaurants Ltd on whether a head tenant was entitled to relief from a forfeiture notice seeking to end a lease for subtenants' breaches of covenants against use for immoral purposes and unlawful sharing of occupancy of a restaurant. Reviews previous authority on the factors to consider when deciding whether to exercise discretion to grant relief in such circumstances, and the court's approach to the tenant's failure to end the immoral use until receiving police confirmation that it was occurring on the premises.
