Abstract

Examines how key provisions of the Fraud Act 2006 resolve certain problems of interpretation and application which arose under the previous law. Explains, with reference to case law, how the 2006 Act's approach to offences of fraud committed by false representation, by failing to disclose information or by abuse of position, and to the offence of obtaining services dishonestly, differs from the legislation it replaces. Considers the extent to which the reforms will clarify and simplify the law of deception.
