Abstract
This paper examines the reasons for the low conviction and reporting rates for rape, including the prevalence of rape myths. The law relating to rape, sexual assault and assault by penetration is explained. The concept of lack of consent, an intrinsic element of these offence, is reviewed in detail. This includes consent in relation to intoxicated complainants, cases involving submission and deceptions that may vitiate consent, including lies regarding the use of contraception, the accused's gender and their sexual health status.
