Abstract
The article considers whether a secret trustee is under an obligation not to disclose the terms of a secret trust. In particular, it examines the nature of the secret trustee's equitable obligation towards the testator and whether the secret trustee can be made liable for disclosure of the trust as a breach of confidence in equity, or under the tort of misuse of private information. The article also discusses the nature of the loss recoverable by the testator and whether the secret trustee's disclosure extends to any actionable loss suffered by the secret beneficiary.
