Abstract

The article considers the Court of Appeal decision in Hudson v Hathway [2022] EWCA Civ 1648 on whether it was necessary for a joint owner of property seeking an increase in their beneficial share to show that they had acted to their detriment in reliance on a changed common intention as to the parties' respective shares. The article also includes practice points for practitioners.
