Abstract

The article considers whether claims in trespass and nuisance are mutually exclusive with reference to American case law, which has recognised microscopic intrusions (comprising dirt, dust, smoke and fumes) as giving rise to successful claims in trespass. The article argues that trespass should be redefined to include intrusion by visible or invisible things which can be measured scientifically.
