Abstract

The article considers the effect of unconscionable behaviour on claims for equitable relief, examining: the claimant's misconduct prior to the hearing; qualified assurances; assurances obtained by misrepresentation or oppression; misconduct subsequent to the court hearing; and non-compliance with a condition forming the basis of the estoppel. The article also lists practice points for the legal practitioner.
