Abstract
The article examines how a beneficial joint tenancy can be severed after the parties purchase their family home in joint names. It looks at when a severance will occur, whether post-acquisition events give rise to a new (as opposed to an existing ambulatory) constructive trust, whether a changed common intention will trigger automatic severance into unequal shares, and the effect of severance in the context of a joint tenancy under an express declaration of trust.
