Abstract

The article reviews the duty of landlords under s.213 of the Housing Act 2004 to protect a tenant's deposit under an authorised scheme, and the clarification in Tiensia v Vision Enterprises Ltd (t/a Universal Estates) [2010] EWCA Civ 1224 of whether a tenant can apply for a penalty where a landlord fails to fulfil the deposit scheme rules within the time limit, but does so prior to the application. Details the conflicting views prior to the case, and the subsequent approaches.
