Abstract

The article comments on Sara and Hossein Asset Holdings Ltd v Blacks Outdoor Retail Ltd (2020) EWCA Civ 1521 on whether a clause in a commercial lease, providing that a landlord's certification of sums payable by a tenant as service charges was conclusive, was to be interpreted as rendering such a certificate conclusive as to whether the works fell within the landlord's repairing obligations and the costs were accordingly recoverable as service charges.
