Abstract

The article examines the Forfeiture Act 1982 in the context of a death caused by careless driving. It discusses in detail the High Court decision in Amos v Mancini [2020] EWHC 1063 (Ch), which held that the forfeiture rule set out in the 1982 Act applied to cases of causing death by careless driving but, where its application would be unjust, its effect could be modified pursuant to s.2 of the Act.
