Abstract

The article looks at the Supreme Court's landmark decision in Whittington Hospital NHS Trust v XX [2020] UKSC 14, which has held that a claimant was entitled to recover damages, following the hospital's admitted negligence in failing to detect her cervical cancer in time, to fund the cost of commercial surrogacy arrangements using donor eggs in a country where such arrangements are not unlawful. The article examines the earlier caselaw, as well as the various arguments raised in the Supreme Court, together with the Supreme Court's ruling.
