Abstract

The article reviews case law clarifying the scope of the duty of care owed by a landlord, as an occupier, towards trespassers under section 1 of the Occupiers' Liability Act 1984. It examines the requirements necessary for imposing the duty, the landlord's liability for common parts of a building, the position if a claimant's trespassing activity was inherently dangerous, and the extent to which a different perspective is taken regarding liability towards children.
