Abstract

The article reflects on the possibility of obtaining a lease of a defined volume of air, unconnected to any physical structure. Highlights Commonwealth authority which illustrates an ability to own airspace and examines English case law which suggests that grant of such a right would be unlikely. Considers frustration of a lease where the tangible property disappears or is taken away, such as by a natural process or during the extraction of minerals.
