Abstract

The article examines the doctrine of frustration as it applies to leases in the light of the High Court ruling in Canary Wharf (RP4) T1 Ltd v European Medicines Agency [2019] EWHC 335 (Ch) on whether Brexit frustrates a lease. It considers the underlying basis of the doctrine, the events which are likely to frustrate a lease and a number of unresolved issues including whether frustration may be relied on by the parties' successors in title.
