The article examines the nature and operation of a tenancy at will in the context of commercial lettings. It discusses the limited purpose of such tenancies and considers, with reference to case law, their role: in transitional periods; for entry into possession pending negotiations for a commercial lease; and for remaining on premises after a lease expires. Notes the impact of the Regulatory Reform (Business Tenancies) (England and Wales) Order 2003.
