Abstract

The article considers a possible reason for the failure to implement draft legislation abolishing the regime governing forfeiture of tenancies. Explains how the ruling in Billson v Residential Apartments Ltd (HL), concerning relief from forfeiture, limits landlords' incentives to terminate tenancies by physically re-entering premises. Reviews key reform proposals, explains why these may need further amendment, and calls for their prompt implementation.
