The article discusses the scope for tenants to challenge a landlord's claim for disrepair by arguing that "patching up" premises complies with repairing covenants without more extensive remedial work. It reviews cases on the choice between repair or replacement, the significance of the standard of repair, when continued patching is futile, the position regarding surveyor-approved patching and whether the cost of improvements may be recovered by service charges.
