Abstract

This article outlines rulings on whether a person, who was not qualified under section 87 of the Housing Act 1985 to succeed to a secure tenancy, could hold the legal estate on trust during the minority of a qualifying child. The article assesses whether there are circumstances when the estate should vest in the local authority in trust for the minor. It also identifies practical difficulties and problems of principle that could arise from a minor's succession to a secure tenancy.
