Abstract

This article comments on a non-owning cohabitant's general lack of property rights and discusses how a cohabitant with children can claim capital provision under Schedule 1 to the Children Act 1989, although for the benefit for the child and not directly for their own benefit. The article also highlights the relevant criteria for making an award, including the additional criteria in cases where an order is sought against a person who is not the child's parent.
