This article considers the possibility of disclosing beneficial interests on the land register. It examines the arguments for such disclosure, as well as the potential impact that transparency would have on the rights of landowners to privacy and property under the Human Rights Act 1988. It also advocates for a related amendment to the Land Registration Act 2002 requiring completion of the TR1 form to be mandatory. The article looks at latest developments involving a register of beneficial owners and controllers of UK companies and disclosure of beneficial ownership of foreign companies that purchase land or property in England and Wales. It is argued that it would not be too great a leap forward to create a public register of beneficial owners of registered land as part of the government's ongoing strategy to combat economic crime and money laundering.
