Abstract
The article analyses when a lease can be terminated using a surrender by operation law. It considers the guidance given by the Court of Appeal in Artworld Financial Corporation v Safaryan [2009]EWCA Civ 303 and the recent High Court ruling in Padwick Properties Ltd v Punj Lloyd Ltd [2016] EWHC 502 (Ch. In the light of the case law, it provides a number of conclusions for legal practitioners.
