Abstract

This case commentary examines the recent Court of Appeal ruling in Erimus Housing Ltd v Barclays Wealth Trustees (Jersey) Ltd [2014] EWCA Civ 303. The commentary explains the ruling and argues that the tenancy at will has come to serve a much reduced purpose in safeguaring the interests of business occupiers during a period of negotiation pending the grant of a more enduring interest in property. It is this transitional function of the tenancy which comtinues to play an important role in modern leasehold law.
