Abstract

The article reflects on the arguments for and against the death penalty in the light of the unsafe conviction of Derek Bentley for the murder of a policeman in 1952. In particular, it considers the utilitarian argument for the death penalty, as well as examining the humanitarian perspective which sees the death penalty as prima facie evil.
