Abstract

Reviews the Law Commission's revised proposals for the reform of homicide in its 2006 report, Murder, Manslaughter and Infanticide. Notes the division of of murder into first and second degree murder and that there is no distinction between premeditated and spontaneous acts. Reviews partial defences including provocation, diminished responsibility, and killing as part of a suicide pact and examines the proposal that duress becomes a complete defence for first degree, second degree and attempted murder.
