Abstract

The article considers the extent to which a landlord that holds a reversionary interest could sue in trespass or nuisance, noting John Smith & Co (Edinburgh) Ltd v Hill [2010] EWHC 1016 (Ch) on whether a reversioner could sue upon a temporary nuisance which affected the demised property and Walton Family Estates Ltd v GJD Services Ltd [2021] EWHC 88 (Comm) on whether a freehold owner of an aerodrome holding only a reversionary interest could sue in trespass to obtain an order to remove aircraft.
