Abstract

The article reviews case law on proprietary estoppel and the formalities prescribed by the Law of Property (Miscellaneous Provisions) Act 1989 s.2(1), including the overlap between estoppel and constructive trust and the nature of equitable relief in the light of the High Court decision in Thandi v Saggu [2023] EWHC 2631 (Ch).
