Abstract

The article considers mutual wills made by oral agreement, the operation of section 2 of the the Law of Property (Miscellaneous Provisions) Act 1989, and the doctrine of proprietary estoppel. It argues that there is no reason why proprietary estoppel should not be applied, in appropriate cases, to resolve the problems associated with oral agreements intended to give rise to mutual wills which do not comply with section 2(1) of the 1989 Act.
