Abstract

The article considers why beneficial interests are not entered on the land register and reflects on the potential for such information to be disclosed. In particular, it examines the human rights issues involved, the need to place on a mandatory footing completion of the current TR1 form (which asks how property is to be held beneficially), the new Register of Overseas Entities introduced under the Economic Crime (Transparency and Enforcement) Act 2022 and the Law Commission's current views regarding the treatment of beneficial interests under the Land Registration Act 2002.
