Abstract

The article discusses issues arising from mutual wills and the constructive trust imposed following the death of one of the parties. It highlights Healey v Brown [2002] WTLR 849 that s.2 of the the Law of Property (Miscellaneous Provisions) Act 1989 applied to a contract made between testators making mutual wills. It also notes alternatives to a constructive trust.
