Abstract

The article reviews cases illustrating the operation of the beneficiary principle, that a trust for benevolent or public purposes must have a human beneficiary to be enforceable, and the circumstances in which a non-charitable private purpose trust may be upheld. It also calls for legislation on private purpose trusts.
