Abstract

The article discusses, with reference to case law, the circumstances under which it is possible for children to succeed to tenancies under the Housing Act 1985. It reviews circumstances in which an equitable tenancy is created in favour of a minor, the position where children have nobody to care for them after the tenant's death, and the potential objections to using trusts to allow minors to succeed to secure tenancies in equity.
