Abstract

The article examines the circumstances in which the courts will imply a surrender of a tenancy where the tenant has ostensibly left the demised presmises. In particular, considers what constitutes a relinquishment of possession by the tenant and what amounts to a landlord's acceptance of possession. Agreements to surrender are also examined in the light of recent case law.
