Abstract

This issue of Practitioner's Page explains the law on consensual termination of residential tenancies. Sets out the limits on the court's jurisdiction to order possession of a protected or statutory tenancy based on an agreement to surrender. Considers the position where there has been an express or implied surrender of the tenancy by the tenant. Discusses the court's jurisdiction to make a consent order in possession proceedings, based on an express or implied admission of facts. Lists the points emerging from the applicable case law. Provides a draft agreement to surrender and draft consent order.
