Abstract

Reviews case law on dishonest assistance, and liability for knowing receipt. Comments on the Chancery Division ruling in Starglade Properties Ltd v Nash on whether a director who acted in breach of trust in not paying a sum of money to a company as agreed, instead paying the money to himself and his company's creditors, was liable for dishonest assistance and knowing receipt. Considers the different meanings given to dishonesty and unconscionability, and the issue of accessory liability.
