Abstract

This issue of Practitioner's Page examines the legal rules applicable when leases are granted by, or to, more than one party. Reviews the procedure for granting a lease of a co-owned property, the position where only one co-owner purports to grant a lease and whether co-landlords must act together in all matters concerning the lease. Discusses how to establish if flat sharers are really co-tenants, the actions which a co-tenant can perform unilaterally and whether landlords leasing to co-tenants must involve both in any enforcement proceedings.
