Abstract

This, the first of two articles on the Law Commission's proposals to reform the homicide legislation, explores whether the separation of the charges into first and second degree murder as well as manslaughter would achieve fairer labelling and sentencing. Summarises the existing law and defences in relation to homicide and sets out the ingredients of the proposed new offences.
