Abstract

The article gives advice to solicitors acting for a spouse who may be influenced into charging their share of the family home as security for their spouse's debt. It discusses the scope of their duty following the House of Lords' decision in Royal Bank of Scotland Plc v Etridge (No.2) [2001]UKHL 44.
