Abstract

The article reviews the duty of landlords under s.213 of the Housing Act 2004 to protect a tenant's deposit under an authorised scheme, and the clarification in Tiensia v Vision Enterprises Ltd (t/a Universal Estates) [2010] EWCA Civ 1224 of whether a tenant can apply for a penalty where a landlord fails to fulfil the deposit scheme rules within the time limit, but does so prior to the application.
