Abstract

The article discusses how to apply the commorientes rule under s.184 of the Law of Property Act 1925, when a couple died in a single incident, to the inheritance of jointly-owned property. It also examines whether it would be fairer to treat the joint tenancy as severed than to benefit only the younger joint owner's heirs.
