Abstract
Reviews the Supreme Court ruling in FHR European Ventures LLP v Cedar Capital Partners LLC that, where an agent receives a benefit in breach of their fiduciary duty, that benefit is held on constructive trust for the principal, giving the principal a proprietary remedy for the amount of the bribe or commission. Traces the progress of the case and the arguments set out in the Court of Appeal.
