Abstract

Examines the application of the presumption of equality to cases involving joint ownership of property and how this might be adjusted where there has been post-acquisition expenditure on the property. Comments on how such a circumstance might affect an express declaration of trust. Reports the results of a study on whether clients were given sufficient legal advice to appreciate all the consequences of having a home in joint names.
