Abstract

The article discusses whether a declaration of a sub-trust by an intermediate trustee of land must be in writing under section 53 of the Law of Property Act 1925, depending on whether the sub-trust is a disposition of an equitable interest. It reviews case law on whether the intermediate trustee could "drop out" or remain a trustee. It also examines the difference between a beneficial and equitable interest and whether to distinguish active and passive sub-trusts.
