Abstract

This article examines case law on the circumstances when a landlord or a tenant may be estopped from challenging the validity of a notice or an application for the renewal of a business tenancy under the Landlord and Tenant Act 1954, Pt II or may be deemed to have waived the right to do so. It assesses the distinction between waiver by election and estoppel in this context. It also considers how it may be possible for a tenant to serve a request for a new tenancy in the knowledge of the facts undermining the validity of the landlord's notice and still preserve the right to object.
